Términos de uso

Estos términos regulan el uso de davarlabs.com y del CRM de Davar Labs (crm.davarlabs.com y las copias que operamos para clientes). Davar Labs es operado por Bruno Belucci desde Argentina. Contacto: info@davarlabs.com.

El sitio

El sitio presenta nuestros servicios y una guía de precios orientativa. Los rangos de precio y plazos son estimaciones, no una oferta: el precio y el alcance de un proyecto se fijan en una propuesta escrita.

Proyectos

Cada proyecto se rige por la propuesta o el contrato que firmamos con el cliente, incluida la garantía de entrega del prototipo cuando se ofrece. Si algo de esa propuesta contradice estos términos, prevalece la propuesta.

El CRM

• Damos acceso al CRM a las personas que el negocio cliente autoriza. Cada persona cuida su acceso y no lo comparte.
• El negocio es responsable de los mensajes que envía y de contar con el permiso de sus contactos para escribirles, y de cumplir las políticas de WhatsApp, Instagram, Google y las demás plataformas que conecte.
• Las integraciones con terceros (WhatsApp, Instagram, Google Calendar, Brevo y otras) dependen de esos servicios. Si un tercero cambia o interrumpe su servicio, la función que depende de él puede dejar de estar disponible.
• No se puede usar el CRM para enviar spam, contenido ilegal o engañoso, ni para intentar acceder a datos de otros.
• Los datos que el negocio carga en el CRM son del negocio. Puede pedirnos una copia o su borrado al terminar el servicio.

Disponibilidad y responsabilidad

Trabajamos para que el servicio esté disponible y funcione bien, pero se presta "tal cual", sin garantía de que nunca falle. En la medida en que la ley lo permita, no respondemos por daños indirectos ni por lucro cesante, y nuestra responsabilidad total se limita a lo que el cliente nos pagó en los últimos tres meses.

Cambios y ley aplicable

Podemos actualizar estos términos; publicaremos la nueva versión aquí con su fecha. Se rigen por las leyes de la República Argentina.

The website

The website presents our services and an indicative pricing guide. Price and timeline ranges are estimates, not an offer: a project's price and scope are set in a written proposal.

Projects

Each project is governed by the proposal or contract we sign with the client, including the prototype delivery guarantee where it is offered. If anything in that proposal conflicts with these terms, the proposal prevails.

The CRM

• We give CRM access to the people the client business authorises. Each person looks after their own access and does not share it.
• The business is responsible for the messages it sends, for having its contacts' permission to message them, and for following the policies of WhatsApp, Instagram, Google and any other platform it connects.
• Third-party integrations (WhatsApp, Instagram, Google Calendar, Brevo and others) depend on those services. If a third party changes or stops its service, the feature that relies on it may become unavailable.
• The CRM may not be used to send spam or illegal or misleading content, or to try to access other people's data.
• The data a business puts into the CRM belongs to that business. It can ask us for a copy, or for its deletion, when the service ends.

Availability and liability

We work to keep the service available and working well, but it is provided "as is", without a guarantee that it will never fail. To the extent the law allows, we are not liable for indirect damages or lost profits, and our total liability is limited to what the client paid us in the last three months.

Changes and governing law

We may update these terms; we will publish the new version here with its date. They are governed by the laws of the Argentine Republic.
